Welcome to Ascension. These Terms of Service ("Terms") govern your access to and use of our services ("Services"), including when you:

• Download, install, or use our mobile application (Ascension - Facial Analysis), or any other application of ours that links to these Terms
• Access facial analyses, ratings, visualizations, insights, or any other features provided within the Service
• Purchase or manage a subscription, or engage with us in any other related way, including any sales, marketing, or events

Please read these Terms carefully. By downloading, installing, accessing, or using Ascension, you acknowledge that you have read, understood, and agree to be bound by these Terms. I. ACCEPTANCE OF TERMS

By downloading, installing, accessing, or using Ascension, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

II. ELIGIBILITY

You must be at least 13 years old to use Ascension. If you are under the age of majority in your jurisdiction (typically 18), you may only use the Service with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. By using the Service, you represent and warrant that you meet these requirements and have the legal capacity (or appropriate parental consent) to enter into this agreement. If you do not meet these requirements, you may not access or use the Service.

III. EDUCATIONAL PURPOSES ONLY

Ascension is designed strictly for educational, informational, and self-improvement purposes. All content, facial analyses, ratings, scores, visualizations, protocols, and recommendations generated within the Service are produced algorithmically and are provided for general guidance only. They are not professional advice and are not a substitute for consultation with a qualified expert. You should not rely on the Service as the sole basis for any significant personal, health, or appearance-related decision.

IV. MEDICAL DISCLAIMER

Ascension does not provide medical advice, diagnosis, or treatment, and the Service is not intended to diagnose, treat, cure, or prevent any disease or condition. Ascension is not a medical device and has not been evaluated or cleared by the U.S. Food and Drug Administration or any other regulatory authority. Always consult a qualified healthcare professional, dermatologist, or other licensed practitioner before making any decision regarding your health, skincare, supplements, diet, fitness, hormones, or cosmetic procedures. If you are experiencing a medical emergency, contact your local emergency services immediately.

V. USER RESPONSIBILITY

You are solely responsible for any actions, decisions, or outcomes resulting from your use of the Service. Ascension, its creators, operators, contractors, affiliates, and licensors assume no liability for any outcomes — direct, indirect, incidental, or consequential — arising from your reliance on the Service or its content.

VI. USE LICENSE

Subject to your compliance with these Terms, Ascension grants you a limited, non-exclusive, non-transferable, revocable license to download and use one copy of the Service on a device you own or control, solely for your personal, non-commercial use. You may not copy, modify, reverse engineer, decompile, scrape, distribute, sublicense, rent, lease, resell, or create derivative works from any part of the Service, except as expressly permitted by applicable law.

VII. ACCEPTABLE USE

You agree not to use the Service to:

• submit content that is unlawful, harassing, abusive, or that infringes the rights of others;
• upload photographs or likenesses of any person without their informed consent;
• attempt to interfere with, disrupt, reverse engineer, or gain unauthorized access to the Service or its underlying systems;
• use automated means to access the Service or collect data from it; or
• use the Service in any manner that violates applicable laws or regulations.

VIII. USER-SUBMITTED CONTENT

You retain ownership of the photographs, images, and information you submit to the Service. By submitting such content, you grant Ascension a limited, worldwide, royalty-free license to process, store, and analyze that content solely for the purpose of providing the Service to you. You represent and warrant that you have all necessary rights and permissions to submit any content you provide.

IX. SUBSCRIPTIONS AND PAYMENTS

Some features of Ascension require a paid subscription. Subscriptions are purchased and billed through the Apple App Store in accordance with your Apple ID account settings. Subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions at any time in your Apple ID account settings. Prices are disclosed at the point of purchase and may change with appropriate notice.

X. REFUNDS

All subscription purchases are processed by Apple and governed by Apple's refund policy. Refund requests must be submitted directly to Apple through your Apple ID account. Ascension does not process refunds directly.

XI. THIRD-PARTY SERVICES

The Service integrates with third-party providers, including the Apple App Store (payments and distribution), Superwall (paywall infrastructure), and analytics providers such as Mixpanel. Your use of those services is subject to their respective terms and privacy policies. Ascension is not responsible for the practices, availability, or content of any third-party service.

XII. INTELLECTUAL PROPERTY

All content, design, software, models, trademarks, logos, and other materials associated with Ascension are owned by or licensed to Ascension and are protected by intellectual property laws. Nothing in these Terms transfers any ownership or licensed rights to you beyond the limited license granted in Section VI.

XIII. DISCLAIMER OF WARRANTIES

The Service and its materials are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Ascension disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. Ascension does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that results obtained will be accurate or reliable.

XIV. LIMITATION OF LIABILITY

To the fullest extent permitted by law, in no event shall Ascension, its creators, affiliates, licensors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of or inability to use the Service, whether based on warranty, contract, tort, statute, or any other legal theory.

XV. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Ascension and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your submitted content, your violation of these Terms, or your violation of any rights of a third party.

XVI. TERMINATION

Ascension may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and indemnification — shall survive.

XVII. PRIVACY

Your privacy matters to us. Our handling of personal information — including facial measurements, device data, and usage analytics — is described in our Privacy Policy, which is incorporated into these Terms by reference. Please review it before using the Service.

XVIII. CHANGES TO THESE TERMS

We may update or modify these Terms from time to time. Material changes will be reflected by updating the effective date or by providing notice within the Service. Your continued use of Ascension after changes become effective constitutes your acceptance of the updated Terms.

XIX. GOVERNING LAW AND DISPUTES

These Terms are governed by and construed in accordance with the laws of the United States and the State of Tennessee, without regard to conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Tennessee, and you consent to the jurisdiction of those courts.
